⚖️ Propagation material in Germany – The next grey area?

Cannabis has been partially legal in Germany since April 1, 2024. But what many underestimate: The greatest economic opportunity—and at the same time the biggest legal minefield—lies in so-called "propagation material."

🌱 What is “propagation material” anyway?

According to the law, propagating material includes everything that serves to reproduce the plant. This includes:

  • Seeds (whether feminized or not),
  • cuttings,
  • Tissue and cell cultures,
  • mother plants,
  • but also pollen.

The sale, possession, or trade of these materials is subject to strict regulations—or may even be prohibited depending on the context. Seeds , which are classified as "consumer products," are particularly in a legal gray area.

The KCanG allows private ownership and cultivation by cultivation associations – but not the free trade of propagation material .

Many market participants are currently using a legal trick: selling the seeds not as “consumables,” but as “collector’s items” or “botanical products” – with the addition “not intended for cultivation.”

But be careful: As soon as a “cultivation-relevant” description appears in social media or shop texts, it can be considered advertising for consumption – and that is clearly prohibited.


💡 What does this mean for breeders & brands?

  1. Clear separation of sales and cultivation : The brand may not grow and sell seeds at the same time.
  2. Distribution through third parties : Many brands go through “external distributors” or foreign offices.
  3. Product text = minefield : Not a word about effect, THC, taste, yield or effectiveness!

📉 What happens if you do it wrong?

Some German shops have already been reported for "prohibited advertising" or "violation of the Narcotics Act." While most cases have been dropped, warnings, shop closures, and reputational damage are real risks.


📈 Conclusion: Opportunity with risk

Propagation material is the backbone of the cannabis industry—but currently, in Germany , it can only be used with tact . Those who do it right can now secure a market share that will finally be predictable in 2–3 years thanks to clear legislation.
